Megapass Terms & Conditions

  1. Introduction
    1. These are the terms and conditions under which Travel Booking Services 2016 GP Limited, trading as Megapass offers you access to the website megapass.co.nz offering combo passes and services.
    2. By using the Megapass website you are agreeing to these terms and conditions, if you do not agree to these please refrain from using the website and the services.
    3. Terms and conditions may be amended in whole or in part by Megapass (Travel Booking Services 2016 GP Limited) at anytime, at its discretion. Amendments will be effective immediately upon posting of the amended terms and conditions on this website. You are responsible for ensuring you are familiar with the latest terms and conditions. Your continued use of the website or the services represents your agreement to be bound by the amended terms and conditions. These terms and conditions were last updated on 12 April 2018.
    4. Where these terms and conditions refer to "you", "your", "customers", "customer", "the user" or "users", we mean any individual using the website or other services.
    5. Where these terms and conditions refer to "operator" or "operators", we mean any individual offering activities, products or services on megapass.co.nz
    6. Where these terms and conditions refer to "Megapass", "our", "us" or "we" we mean the Megapass website owned and operated by Travel Booking Services 2016 GP Limited.
    7. All prices displayed on the website are inclusive of New Zealand GST unless otherwise stated.
  2. Consumer Rights
    1. Consumer protection legislation established rights for each customer. No part of this agreement is intended to interfere with these consumer rights. These Consumer Rights include: Statutory guarantees under the New Zealand consumer protection laws, including as to the title and delivery of goods, that goods will be of acceptable quality, match their description and be fit for any purpose made known to the supplier and that services supplied will be provided with reasonable care and skill and be reasonably fit for any specified purpose. When a statutory guarantee is breached, consumers are entitled to a range of remedies including, in some cases, damages for reasonably foreseeable losses; and Non-excludable implied warranties that financial services will be provided with reasonable care and skill and that the services and any materials supplied in connection with them will be fit for any specified purpose.
  3. Use of the Megapass Wesite
    1. You may only use the Megapass website if you are capable of entering into a legally binding contract. By entering into this agreement, you represent and warrant to Megapass that you are eligible to use our products and services.
    2. You agree to provide complete, accurate, and current personal information when purchasing product and services.
    3. Megapass reserves the right at its discretion to decline to provide you with the products or services at anytime without entering further discussions with you. Any such termination shall not affect any right or remedy to which Megapass may be entitled.
    4. Megapass will send you emails relating to your transactions and other activities on the website.
    5. Megapass may also send regular electronic newsletters to Megapass users. Newsletters will contain clear and obvious instructions for how you can unsubscribe from the mailing list.
    6. The inclusion on the website of any third party material or a link to a third party website does not mean Megapass endorses or approves that third party or the third party material.
  4. The Services
    1. Megapass provides the website for you to purchase passes. As part of the services, Megapass staff may also help you over the phone to make purchases on the website, including by entering into the website on your behalf the information required for you to make a purchase. You agree to the use of the website and services for this purpose only.
    2. Megapass is not party to any agreement or transactions between you and an operator. Accordingly you agree not to involve, or attempt to involve Megapass in any dispute or in the resolution of disputes that may arise between you and an operator as a result of the services provided.
    3. Once you proceed through the checkout process you will be asked for your credit card details. Megapass accepts MasterCard and Visa as forms of payment. Once you have confirmed your credit or debit card details, your credit or debit card will be charged 100% of the pass price owing.
      1. Following the confirmation of purchase an email will be sent to your email address (provided during the checkout process) including your purchase receipt and voucher.
      2. Your voucher should be treated as cash and becomes your proof of payment. You must present your voucher to the operator upon check in of each activity.
  5. Passes
    1. All passes are valid for 30 days from the first use of the pass. Once you activate your pass by visiting your first activity or attraction, you will have 30 days to use the remaining activities. Passes are non-refundable and non-transferable, unless required by law.
    2. It is at the discretion of the operator to check for ID upon your arrival at an activity or attraction.
    3. In some circumstances, bookings are essential and will need to be confirmed prior to arriving at an operators location. When necessary this will be stated along with contact information on the voucher.
    4. Due to the nature of many of the activities provided on the site and the environment they are conducted within, operators at times will make decisions to cancel or postpone an activity or experience based on a lack of sufficient numbers, weather, genuine safety concerns or any other events or circumstances that prevent operation. If this occurs, you accept that it is your responsibility to confirm a subsequent date.
  6. Security
    1. Megapass is PCI compliant and do not store any credit card or debit card numbers on their website.
  7. Approval
    1. All purchases which you place with Megapass are subject to approval by Megapass, in our reasonable discretion. We may choose to not approve a purchase, or provide a product/service to you, or we may cancel an approved purchase if:
      1. We reasonably consider this necessary in order to protect the integrity of our systems or the products, prevent fraud, limit the risk of money laundering or terrorism financing, otherwise protect us against any legal, regulatory or non-installment risk
      2. You do not pass our verification or checks
      3. We reasonably suspect, or are aware that you have breached this agreement in a material respect; or
      4. We otherwise reasonably consider the purchase to be suspicious.
  8. Payment, Fees and Charges
    1. Megapass may also charge a payment processing fee (PPF) when purchasing a pass on the website. This fee is non refundable.
    2. Megapass charges no subscription or sign-up fees to the user of their service.
    3. Megapass reserves the right to change at any time the fees charged for our services or the manner in which they are charged, imposed or collected. If we launch a new service, the charges for that service will be effective at the launch of that service unless otherwise stated.
    4. The name on your credit card transaction will be Bookit.co.nz. This is the billing and payment software for the Megapass website.
  9. Cancellations and Refunds
    1. All passes purchased are valid for 30 days from the date of purchase and are non-refundable and non-transferable.
    2. Passes are not able to be redeemed for cash or for any other passes on the website.
    3. Megapass are not liable for any operator cancellations, this is the decision of the operator and may occur for a number of reasons. It is at the operators discretion to allow a subsequent date to be booked. If this occurs, you accept that it is your responsibility to confirm a subsequent date.
  10. Transfers or Assignments
    1. You cannot transfer or assign any rights you may have under this agreement without our prior written consent, which must not be unreasonably withheld.
    2. We may transfer or assign this Agreement, and any rights under this agreement, to a third party without notice to you, or your consent unless the assignment will detrimentally affect your rights under the agreement (in which case we will seek your prior consent to assignment, which consent must not be unreasonably withheld).
  11. Assessment and Checks
    1. We reserve the right to assess, and determine whether to accept or cancel each booking.
    2. We reserve the right to verify your identity, including if required under the Anti-Money Laundering and Counter Financing of Terrorism Act 2009.
    3. You agree to provide any information or documentation reasonably requested by Megapass or an operator to verify your identity in connection with your Megapass purchases.
    4. You authorise us to make, directly or through third parties, any enquiries we consider necessary to verify your identity.
    5. You authorise Megapass (or any third parties providing services on behalf of Megapass) to disclose to third parties, to the extent required or permitted by any applicable laws or regulations, any information in relation to you or your Megapass purchases.
  12. Operator Information
    1. Megapass is not responsible or liable for any unavailability of product or services that an Operator indicated is available in a pass.
    2. The services, all information and materials on the website are provided "as is" and Megapass does not give away any warranties of any kind, whether express or implied. To the maximum extent permitted by law, all representations and warranties (statutory, express or implied) are expressly excluded, including, but not limited to, any implied warranties of merchantability and fitness for a particular purpose. Megapass makes no representation or warranty about, and takes no responsibility or liability for, the quality or suitability of any product or service featured on the website.
  13. Exclusion and Limitation of Liability
    1. Megapass is not liable under any circumstances (including, but not limited to) negligence for any direct or indirect loss or damage (including, but not limited to) general, consequential, special or incidental loss or damages, loss of profits or loss of savings suffered by you or anyone else arising from the direct, or indirect use of the website or services from the use of, or inability to use any product or service purchased using the website or services, even if Megapass has been advised of the possibility of such loss or damages. In any event, if notwithstanding these terms and conditions, Megapass is held liable then Travel Booking Services total liability to you and those claiming through you under any and all causes of action, whether in contract, tort or otherwise, shall not exceed the amount paid by you, if any for using the website.
    2. Megapass will use its reasonable endeavours to ensure the availability of the website and services, subject to any downtime required for maintenance. However, Megapass takes no responsibility for any system unavailability, or any loss or damage that is suffered as a result of the website services being unavailable for any reason. Megapass does not warrant that the website or services will be uninterrupted or error-free, or that the website will be free from viruses or other harmful content. Further, Megapass is not responsible or liable for the corruption of any data or information submitted via the website or held by Travel Booking Services.
  14. Intellectual Property Rights
    1. Travel Booking Services ( and its licensors or suppliers, as the case may be) owns all intellectual property rights in the website and the services (including, but not limited to, text, graphics, logos, icons and sound recordings) and the software and other material underlying and forming part of the services and the website. Megapass is a trademark of Travel Booking Services Limited. You may not without our prior written permission, in any form or by any means:
      1. Adapt, reproduce, copy, store, distribute, print, perform, publish, transmit, or create adaptations from any part of the website or its contents; or
      2. Commercialise, copy, or on-sell any information, or items obtained from any part of the website or its contents.
      3. You agree: not to use any software, process or device to copy, collect or harvest data or other content from the website; Not decompile, reverse-engineer, disassemble or otherwise deal with any software underlying or forming part of the service or website.
      4. Not to do anything or take any action that imposes an unreasonable burden on Megapass computer systems.
  15. Notices and Communications
    1. How we will communicate with you:
      1. This agreement, and any other agreements, notices, or other communications regarding Megapass purchases and the use of our products and services may be provided to you electronically.
      2. You will receive all communications from is in electronic form. Communications will be sent to the email address you have registered during the Megapass checkout process.
      3. You consent to us using the contact details you have provided to us to (i) contact you on an ongoing basis for marketing purposes whether by email, SMS, phone or otherwise (unless you have notified us that you do not wish to receive such communication); and/or (ii) contact you in relation to your Megapass purchase(s).
      4. You acknowledge that we (or any third party providing services on behalf of us) may monitor or record telephone conversations or electronic communications for quality control and training purposes or for Megapass own protection. Megapass does not provide any guarantee that any such monitoring or recording will be retained or retrievable.

  16. General
    1. Governing Law: These terms and conditions are governed by the laws of New Zealand. You must submit to the non-exclusive jurisdiction of the Courts of New Zealand
    2. Waiver and Severability: Megapass will not be deemed to have waived any right under these terms and conditions unless the waiver is in writing and signed by Megapass. Any unlawful or voidable provision in these terms and conditions shall be read down so as to be valid or enforceable or, if it cannot be read down, will be severed without affecting the validity, legality of enforceability of the remaining provisions.
    3. Headings: the headings used in these terms and conditions are included for convenience only and so not affect or limit these terms and conditions.
  17. Privacy
    1. Megapass collects personal information about you through your use of the services and the website, including:
      1. Your contact details; and
      2. Information relating to your use of the website and the content you access
      3. Megapass may also gather information about you from Facebook with your express permission, ans accordance with our Privacy Policy.
    2. You agree that Megapass may use this personal information to assist Megapass to provide the services to you for internal research purposes, to verify your identity, for promoting and marketing other Travel Booking Services products and services to you, and for any other use that you authorise.
    3. Travel Booking Services will provide operators with the information required to facilitate the purchase you made through Megapass
    4. Travel Booking Services uses Bookit (bookit.co.nz) billing and payment system in order to provide you with the Megapass site. View the Bookit Terms and Conditions.
    5. Travel Booking Services will not sell or allow third parties to access your personal information without your consent. Travel Booking Services releases account and other personal information only when it believes release is appropriate to comply with the law to facilitate court proceedings, to enforce or apply Travel Booking Services' terms and conditions or protect the rights, property, or safety of Travel Booking Services, its website users, its members or others.
    6. Please review our privacy policy. By using the website you accept the terms of our privacy policy, as amended from time to time.
